Skilled Lawyers for Divorce and Family Law Appeals in DuPage County

Navigating the process of divorce and other matters of family law can be emotionally taxing. After the judge gives their final ruling, you may feel that your case is over. However, at Calabrese Associates, P.C., we are here to reassure you that your situation is not hopeless. Our compassionate team is ready to help you explore your options for appealing the court's ruling and assist you in taking steps toward a more favorable resolution.

What Is an Appeal?

An appeal is essentially a request for a higher court to reconsider a judgment made in lower court. To prevent the abuse of this system, appeals are only permitted under limited grounds, typically some error in procedure or a misinterpretation of the law. At Calabrese Associates, P.C., we are highly familiar with the laws surrounding family law appeals, so we can advise you of your best course of action after a judge's ruling.

Family Law Appeals in Illinois

Despite a seemingly bleak outlook, there are many ways to approach a family law appeal. The laws that govern divorce, spousal maintenance, property division, the allocation of parental responsibilities (child custody), and child support are very complex. As such, it is not uncommon for a trial judge to misinterpret a particular element in the law.

Similarly, the judge in your case may have dismissed or failed to account for presented evidence. Both of these scenarios could potentially be remedied on appeal, but it is important to act quickly. Depending on your circumstances, you may only have a limited window in which to take advantage of the appeals process.

At Calabrese Associates, P.C., our attorneys will help you analyze your case and the original ruling to determine the best course of action going forward. We will identify any and all possible errors made by the court and develop a appeal strategy designed to give you the best chance at success.

Should I Choose a New Lawyer for My Appeal?

Our attorneys have the utmost respect for fellow practitioners of the law, but we also realize that, in many cases, a fresh approach is exactly what you need. With our team-oriented style of practice and our extensive knowledge of the applicable laws in Illinois, we are often able to uncover details that others, including trial judges, may have overlooked. No matter which law firm represented your interests in your original proceedings, we can provide the representation you need throughout the appellate process.

How Can I Start the Appeals Process?

The appeals process begins by filing a notice of appeal within 30 days of the judge's final ruling. If you do not appeal within this timeframe, you could lose your right to contest the decision in the future. You must serve the notice of appeal to the circuit court clerk, as well as to the other parties involved in the case. In your notice of appeal, you have the option of requesting to reverse, modify, or vacate the old judgment that was made in your case. When filling out this form, be sure to include the date of every court order that you intend to appeal.
