You must also allow a reasonable amount of time before the wedding for each of you to consider the agreement and to enter into it voluntarily. Lastly, you should each retain separate attorneys to ensure you receive adequate legal counsel throughout the process. Lastly, prenuptial agreements cannot include terms that dictate child custody in the event of a divorce, nor can the agreement include terms that adversely affect a child's right to child support.
Even if you satisfy all of these requirements, keep in mind that it is still up to the judge to decide where or not to enforce a prenuptial agreement.
